1. Acceptance of terms
By accessing or using Aperture22 you agree to be bound by these terms. If you do not agree, please do not use the service.
2. Beta access
Aperture22 is currently in beta. Features may change, be removed, or be temporarily unavailable. Beta access is by invitation only. We reserve the right to revoke access at any time.
3. Intellectual property
Aperture22, including all source code, software architecture, user interface designs, scoring systems, coaching methodologies, photography curriculum, knowledge base content, and all associated documentation, is the original intellectual property of Duane Rogers.
Federal Copyright Registration
This work is officially registered with the United States Copyright Office under Case Number 1-15188914171, filed June 19, 2026, in accordance with Title 17 of the United States Code.
Protected Elements
The following elements are explicitly protected under this registration and applicable copyright law:
- The Aperture22 software platform and all source code
- The Photography Intelligence Companion (PIC) coaching system
- The Safari Planner and shot card generation system
- The 10-dimension deterministic image scoring methodology
- The photography knowledge curriculum and curated content
- All visual designs, user interface elements, and brand assets
- All written content, coaching text, and educational materials
- All system prompts, AI orchestration logic, and database architecture
Restrictions
No part of this platform, its code, content, methodologies, or architectural patterns may be reproduced, distributed, modified, publicly displayed, performed, reverse-engineered, or used for commercial purposes without prior written permission from the copyright holder. Unauthorized use may result in civil and criminal penalties under federal law, including statutory damages and injunctive relief.
User-Generated Content
Photographs, notes, safari plans, and all other content created by users within Aperture22 remain the intellectual property of the respective users. Aperture22 does not claim ownership of user content. See our Privacy Policy for details on data handling.

4. Your content
You retain ownership of photos and content you upload. By uploading content you grant us a limited licence to process it for the purpose of providing the service — analysis, storage in your gallery, and plan generation.
You must not upload content that:
- You do not have the right to share
- Violates the rights of others
- Is illegal, harmful, or offensive
5. Acceptable use
You may not use Aperture22 to:
- Attempt to reverse engineer, scrape, or abuse the API
- Create accounts for automated or bulk use without permission
- Circumvent usage limits or access controls
- Resell or redistribute access to the service
6. AI-generated content
Coaching feedback, plan content, and analysis are generated by AI and may contain errors. Aperture22 content is for informational and educational purposes. Always exercise your own judgement in the field — especially for wildlife encounters, navigation, and safety decisions.
6a. Field Safety and Location Guidance
Aperture22 suggests shooting locations, GPS coordinates, and standing positions generated from public map data. This data can be incomplete, inaccurate, or out of date. You are solely responsible for assessing terrain, water, weather, tides, wildlife, and physical safety before acting on any suggestion, and for confirming you have the legal right to access any location. Aperture22 does not verify land ownership, public access, or on-site conditions. Never enter unsafe terrain, water, or private property based on a suggestion from the service.
Generated plans — including shot positions, shooting directions, sun and lighting guidance, and timing — are AI-assisted reference guides, not guaranteed-accurate instructions. They are a strong starting point built from the details you provide and the best available public data. Verifying and refining a plan for your specific shoot, and confirming positioning, access, and conditions on-site, is your responsibility. If you use a plan without reviewing or editing it, you accept it as-is.
7. Service availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or emergency fixes at any time.
8. Limitation of liability
To the maximum extent permitted by law, Aperture22 is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service.
9. Changes to these terms
We may update these terms. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email.
11. Uploaded Documents
When you upload a document (e.g., an event flyer or itinerary), its contents are processed by our third-party AI services to extract locations and details (see the Privacy Policy). Do not upload documents containing information you lack the right to share, including others' personal data.
12. Beta Scope and Forthcoming Features
Aperture22 is in active beta. During beta, the following features are operational:
- AI photography planning across single events, day shoots, portrait, architecture, and multi-day (up to 7 days) trips.
- Photo analysis and coaching using AI scoring across multiple dimensions.
- Subject detection in uploaded photos to inform coaching context (e.g., identifying landscape, portrait, architecture).
- OpenStreetMap-based terrain verification for shooting position safety.
The following capabilities are planned for full product launch and are not active in beta:
- Location identification from photos using AI vision — when enabled by user opt-in, this will detect landmarks and venues to pre-populate location data when GPS metadata is missing.
- Granular privacy controls in user profile settings, including per-feature opt-in/opt-out for subject detection, location identification, and other AI processing.
- Google Maps integration and Street View scouting for higher-tier subscribers, providing premium-accuracy geocoding, location validation, and visual location scouting in plan pre-flight.
- Subscription tiers — Aperture22 will offer tiered access at full launch across Explorer, Adventurer, Expedition, and Expedition+ tiers. Tier-specific features and pricing will be announced before launch. Beta participation is free.
- Stock photo and footage marketplace — at higher tiers, photographers will be able to sell their own images and footage through an integrated marketplace, with royalty rates up to 65% per sale. Marketplace terms, eligibility, and seller policies will be announced before launch.
We will notify you when these features become available. Until then, your use of Aperture22 is limited to the beta features listed above. We may modify, add, or remove features during beta to improve the product.
13. Governing law
These terms are governed by the laws of the jurisdiction in which Aperture22 operates. Disputes will be resolved in the applicable courts of that jurisdiction.
